In the order dated 28.11.2024 inadvertently "WPA 14210 of 2024" was transcribed. The same should read as "WPA 14210 of 2021".

Petitioner approached this court with several prayers including prayer for directing the CBI Authorities to investigate into the allegations in respect of the information which was furnished to them.

Earlier learned advocate appearing for the state submitted that no case was registered by the State Police.

So far as the Central Bureau of Investigation is concerned a report has been submitted.

Report reflects that the nature of the offence complained of in the complaint dated 15.08.2019 of one Tarun Routh do not come under the purview of the CBI and the same has been closed.

The communication to the learned counsel made by the Superintendent of Police, CBI, ACB Kolkata be kept with the record.

In view of the aforesaid, petitioner is directed to approach the jurisdictional Magistrate under section 175(3) of the BNSS. It would be the discretion of the Magistrate after considering the accusations whether a cognizable offence has been made out for the purposes of investigation and pass necessary directions.

Petitioner is further aggrieved in respect of certain notice which were served upon him by the Detective Department, Barrackpore Police Commissionerate. Since the same relates to the year 2021, I am not inclined to interfere with the same after three years.

With the aforesaid observations the writ petition being WPA 14210 of 2021 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
