Mr. Bhattacharya, learned advocate appearing for the petitioners submits that the subject matter of the present case relates to re-payment of loan. The petitioners have been implicated in the instant case on the basis of an application under Section 156(3) of the Code of Criminal procedure which was filed by the de facto complainant and subsequently case being registered. Further detention of the petitioner is unwarranted in the background of the facts of the case.

Mr. Roy Choudhury, learned advocate appearing for the State produces the Case Diary and opposed the prayer for bail.

I have perused the allegations made in the application under Section 156(3) of the Code of Criminal Procedure and I find that the allegations also incorporate previous transaction having taken place between the parties.

Having regard to the period of detention of the present petitioners, I am of the view that further detention is unwarranted. As such, the prayer for bail is allowed.

Accordingly, the petitioners shall be released on bail upon furnishing bond of Rs.10,000/-(Rupees Ten Thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Chief Judicial Magistrate, Hooghly. The petitioners shall co-operate with the investigating officer and shall not tamper with any evidence of the case. The application for bail, being CRM(SB) 151 of 2022, is, thus, disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
