C.R.M. (M) 752 of 2025 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Pukhuria Police Station Case No. 132/2021 dated 07.04.2021 under Sections 498A/302 of the Indian Penal Code.

Shaila Afrin Mr. Debansu Ghorai ... For the State Learned counsel for the petitioner submits that the petitioner is in custody for 4 and 1⁄2 years. The petitioner is the husband of the deceased and has been falsely implicated. The injuries stated in the report do not corroborate the version of the minor son of the petitioner.

Learned counsel for the State opposes the prayer. I have considered the material on record. The minor son of the deceased and the petitioner is the eye witness to the incident and has supported the prosecution case. The discrepancies pointed out by the petitioner shall be dealt with by the learned trial Court at the appropriate stage of trial. 8 out of 22 witnesses have been examined so far. The petitioner is in custody for about 4 and 1⁄2 years. Offences, if proved, shall attract mandatory life imprisonment.

Considering the gravity of the offence and prima facie involvement of the petitioner therein, the bail prayer is rejected at this stage.

Learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties. The application for bail is disposed of.
