No. 214, Mouza - Khirpai, District - Paschim Medinipur. Learned advocate appearing on behalf of the West Bengal State Electricity Distribution Company Limited (WBSEDCL) submits that although a specific location had been identified for the erection of two poles to facilitate the shifting of the line, due to objection raised by the private respondents, the poles could not be erected despite two successive attempts by WBSEDCL.

The private respondents are not represented.

Having regard to the nature of the dispute involved in this writ petition, I am of the view that the matter ought to be adjudicated by the concerned District Magistrate in terms of Rule 3(b) of The Works of Licensees Rules, 2006.

Accordingly, this writ petition is disposed of with a direction upon WBSEDCL to approach the District Magistrate, Paschim Medinipur, within a period of two (2) weeks from date, for adjudication of the dispute.

The District Magistrate shall thereafter hear all concerned parties and decide the matter in accordance with law within a period of three (3) months from the date of receipt of such reference. Accordingly, WPA 13458 of 2025 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
