Learned counsel for the petitioners submits that the petitioner and the de facto complainant are closely related and had a long pending dispute between them. Learned counsel submits that petitioner nos.1 and 2 are sons of petitioner no.3. Petitioner no.3 had two marriages and the children of the two marriages keep fighting with each other over their shares. The present incident was also in the form of free fight between the two parties. The petitioners herein also approach the police for registration of FIR. The police did not register the case and now the petitioners have approached the court of learned Magistrate for directing investigation.

Learned counsel for the State has produced the case diary. The court has gone through the injury report. Since it was a free fight and the parties are related to each other. The petitioners in

the event of arrest be admitted to anticipatory bail on furnishing a personal bond of Rs.5,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of leaned ACJM, Chanchal at Malda. Subject to the further condition that petitioners shall join the investigation as and when directed by the investigating officer and they shall not threaten, intimidate or tamper the prosecution witnesses.

The application for anticipatory bail is, thus, disposed of. 4.
