This instant writ petition has been filed by the petitioner seeking direction upon the West Bengal Information Commission to supply information sought for by the writ petitioner under Section 6 of the Right to Information Act, 2005. 2.

It is the case of the petitioner that he is the owner of 20 decimal of land comprising in Plot No. 1842, J.L. No. 88, R.S. Khatian No. 980 of MouzaPataihat. Subsequently, it created a bata plot bearing No. 1842/2080, measuring about 20 decimals in R.S. Record of Right but, at present, it is found that the Plot No. 1842 of R.S. Parcha reduced the area of land to 17 decimals from 20 decimal and, for that, he seeks such information from the SPIO under Section 6 of the R.T.I. Act on

3rd May, 2023 for ascertaining actual reason for reduction of land area but the information was not supplied by the SPIO.

Being aggrieved by and dissatisfied with the inaction by the SPIO, first appeal was filed under Section 19(1) of the RTI Act, 2005 and same was disposed of with certain directions.

4. The petitioner again feeling aggrieved, filed second appeal before the appellate authority under Section 19(3) of the RTI Act but in vain. Having no alternative, the petitioner filed this writ petition seeking aforesaid directions.

On the other hand, learned counsel appearing for the respondent/appellate authority produces a copy of order dated 10th July, 2025 passed by the Appellate Authority. Same is taken on record.

Upon perusal of said order, it reveals that appeal has already been disposed of by the appellate authority and the SPIO has been directed to furnish a copy of the RS record by certifying the same under RTI Act and send a copy of RS record to the address of the appellant as given in his RTI application within next three weeks and the Commission be accordingly informed the compliance of the same. Copy of the same is also handed over to the petitioner in Court.

Given the aforesaid situation, this writ petition became infructuous.

In view of such circumstances, WPA 13460 of 2025 is, thus, disposed of.

There shall be no order as to costs.

10. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
