Kausik (Rejected) CRM (NDPS) 1376 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 1401/2025 dated 10.08.2025 under Sections 21(c)/27A/29 of the NDPS Act, 1985.

And In the matter of : Hajikul Sekh ......Petitioner.

Mr. Tapodip Gupta Mr. Golam Ahammed Ms. Usashi Chattopadhyay ......for the Petitioner.

Ms. Arushi Rathore ......for the State.

Petitioner has been implicated in the instant case wherein there has been alleged recovery of 1539 Gms. of Brown Sugar.

Learned advocate for the State opposes the prayer for bail and submits although there was no recovery from the petitioner in this case, but there are criminal antecedents of the present petitioner relating to NDPS Cases. Petitioner is in custody for about 3 months. Charge sheet has already been submitted.

At this stage, considering the antecedents of the petitioner, I am not inclined to release the petitioner on bail.

Petitioner would renew his prayer for bail after the evidence of the seizure list witnesses is over. Accordingly, CRM (NDPS) 1376 of 2026 is dismissed at this stage.

Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
