None appears for the private opposite party despite service. The petitioner seeks transfer of Miscellaneous Case no. 98 of 2023(II) pending before the learned Additional Chief Judicial Magistrate, 2nd Court, Haldia to the learned Chief Judicial Magistrate, Purba Bardhaman on two fold counts.

First, the distance between Haldia and the petitioner's residence at Purba Bardhaman is about 200 kms. and it is extremely difficult for the petitioner to travel the said distance, contest the case filed by the opposite party and also bear the expenses of the journey. Second, several litigations by and between the parties are pending before the Purba Bardhaman Court.

Upon consideration of the submission made on behalf of the petitioner, Miscellaneous Case no. 98 of 2023(II) pending before the learned Additional Chief Judicial Magistrate, 2nd Court, Haldia be transferred to the learned Chief Judicial Magistrate, Purba Bardhaman for disposal. Learned Additional Chief Judicial Magistrate, 2nd Court, Haldia is directed to transmit the case records to the learned Chief Judicial Magistrate, Purba Bardhaman within two weeks from the date of communication of this order. Learned Chief Judicial Magistrate, Purba Bardhaman shall either deal with the case himself or assign the same to any other Judicial Magistrate within the jurisdiction for disposal.

CRR 2162 of 2024 is disposed of.
