Affidavit of service filed by the petitioners is taken on record.

The petitioners who are the members of Nowda Panchayat Samity floated a requisition for removal of the Sahakari Sabhapati of the Samity, being the 7th and 8th respondents herein, which was received by the Prescribed Authority on 5th June, 2026. By a notice issued on 10th June, 2026, date of meeting was fixed on 25th June, 2026. The Prescribed Authority issued a subsequent notice on 15th June, 2026 postponing the meeting due to non availability of police assistance. The petitioners seek a direction upon the Prescribed Authority to convene the meeting and complete the procedure in terms of Section 101 of the West Bengal Panchayat Act, 1973.

Upon consideration of the submission made on behalf of the petitioners and the State, this Court directs the Prescribed Authority and Sub Divisional Officer, Berhampore Sadar, being the 4th respondent herein, to convene the meeting within ten days from the date of communication of this order and take the proceeding to its

logical conclusion in terms of the provision laid down under Section 101 of the Act of 1973.

The Officer in charge, Nowda Police Station, being the 10th respondent herein, is directed to render necessary assistance to the 4th respondent so that the meeting is held peacefully and without any disturbance from any corner whatsoever.

The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
