It appears from such report that in the incident that led to the death of one Ranjay Kumar Srivastav the actual target was one Mr. Sonu Kumar Shaw, who is a local politician and has been afforded protection.

Counsel for the petitioner submits that since he is an eye-witness to the incident as also a named witness for the prosecution, he has been receiving threats when he went to depose evidence and on the way to the police station. The petitioner further submits that he has been receiving threats from one Sabab Alam, one of the associates of the accused persons.

The Officer-in-Charge, Khardah Police Station shall forthwith investigate into such threats received by the petitioner.

The petitioner admittedly is an eye-witness in the criminal proceedings. The threat perception to an eye-witness in a murder case, cannot be overstated. In that view of the above, the Officerin-Charge, Khardah Police Station shall arrange appropriate protection to the petitioner for a period of one month initially. Such protection may be reviewed after reassessment of threat perception after a period of one month.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
