The order impugned is an appealable order. The petitioner is directed to prefer an appeal in accordance with law before the Tribunal. If the certified copy of the order is not available with the petitioner, the petitioner is granted leave to prefer an appeal before the learned Tribunal with a photo copy of the demolition order.

The petitioner is also at liberty to pray for stay of the order, which shall be decided in accordance with law upon adjudication of the prima facie case by the learned Tribunal..

The demolition order is stayed for a period of eight weeks from date to enable the petitioner to move before the learned Tribunal for an appropriate order. If no stay order is passed by the Tribunal within the period mentioned hereinabove, the Kolkata Municipal

Corporation shall be at liberty to proceed in accordance with law.

This writ petition is disposed of.

There will be, however, no order as to costs. Parties are directed to act on the basis of the server copy of this order.
