Learned advocate appearing for the petitioner submits that the subject matter of recovery is 300 bottles of Phensedyl from the joint possession of all the petitioners. Both the petitioners are in custody for about a year.
It has been pointed out that after framing of charge only part of PW 1 has been examined and the case is in progress. Learned advocate for the State opposes the prayer for bail.
Having considered the period of detention of the present petitioners, petitioners who are ladies, I am inclined to release the petitioners on bail.
Petitioners, namely Susmita Biswas Pandit & Chhaya Biswas shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court under NDPS Act, Additional Sessions Judge, 4th Court Alipore. If on bail the petitioners would be physically present on each and every date fixed by the learned Trial Court. Petitioners shall not leave the jurisdiction of District of 24 Parganas, South without the permission of the learned Special Court. Accordingly, CRM (NDPS) 740 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
