This application under Article of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge (Sr. Div.), 1st Court at Barasat to dispose of the pending interlocutory applications filed in Title Suit No.743 of 2023 expeditiously.

From the order sheets appended to this application, this Court finds that September 25, 2025 has been fixed for acceptance of written statement and hearing of the application under Order 39 Rule 4 of the Code of Civil Procedure.

In view thereof, CO 2118 of 2025 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 1st Court at Barasat to make an endeavour to dispose of the application under Order 39 Rule 4 of the Code of Civil Procedure and the application for acceptance of written statement as expeditiously as possible without granting any unnecessary adjournments to either of the parties. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
