In the matter of : Deep Mazumder ..... petitioner Mr. Anirban Guhathakurta Mr. Sujan Chatterjee ....For the petitioner Though the petitioner has filed this application for quashing of the C. Case No. 376 of 2020 under Sections 18/19/20/22 of the Protection of Women from Domestic Violence Act, 2005, in course of the hearing of this application, it appears that the petitioner, seeks to challenge an order dated October 21, 2020, passed by the learned Judicial Magistrate, 1st Court, Bidhannagar, 24Parganas (North), whereby an interim monetary relief of Rs.5,000/- per month was directed to be paid by him to the opposite party.

Since the said order is appealable under Section 29 of the Protection of Women from Domestic Violence Act, 2005, this application is not entertained.

The petitioner will be at liberty to challenge the said order dated October 21, 2020, if so advised, in accordance with law. It is made clear that I have not gone into the merit of the said order passed by the learned Judicial Magistrate, 1st Court, Bidhannagar, 24-Parganas (North).

The application being CRR 1800 of 2021 is, thus, disposed of. All parties shall act upon the server copy of this order duly downloaded from the official website of this Court. (Kausik Chanda, J.)
