Kausik (Rejected) CRM (NDPS) 921 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Muchipara Police Station Case No. 30 of 2024 dated 06.03.2024 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Mr. Chakraborty, learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year and 8 months and he has been falsely implicated in connection with the instant case on the accusation of recovery of 2147 bottles of Codin Phosphate.

Learned advocate for the State opposes the prayer for bail and submits that whole of the seizure was videographed and there is no possibility of any manipulation as has been alleged at the behest of the petitioner. All efforts would be exerted to conclude the trial at the earliest. State is directed to take steps for concluding the examination of the prosecution witnesses within a period of 3 months from the next date so fixed. In case, the Court is lying

vacant, the in-charge Court will record the evidence. No unnecessary adjournment be granted to any of the parties. The trial of the case would continue in spite of any resolution of the local bar.

Petitioner would be at liberty to approach this court after the aforesaid period is over.

Accordingly, CRM(NDPS) 921 of 2025 is dismissed at this stage.
