The petitioner is one of the eight accused persons. The charge is under Narcotic Drugs and Psychotropic Substances Act. Allegedly, huge quantity of Ganja was recovered from the possession of the petitioner.

The petitioner says that he is in custody for one year five months. He is also suffering from critical ailments. He prays for bail.

Learned advocate for the State opposes the prayer for bail. He points out that the bail prayer of the co-accused persons has been turned down by this Court on January 3, 2024. Seven out of ten witnesses have already been examined. In view of the restriction under Section 37 of the N.D.P.S. Act, we are not inclined to entertain the petitioner's prayer for bail.

The application for bail is, accordingly, rejected. Signed By :

CRM (DB) 867 of 2024 is dismissed.

However, since the petitioner has been in custody for a long period of time, we request the learned Trial Court to conclude the trial within four months (excluding official vacations) from the date of communication of this order to the learned Trial Court by the parties, without granting unnecessary adjournments to either of the parties.
