Ms. Trina Mitra ...... for the State Petitioner renews his prayer for bail. He is in custody for more than five years. It is submitted that there is hardly any progress in the trial of the case.

Learned Additional Public Prosecutor opposes the prayer for bail. He submits petitioner has criminal antecedents and criminal cases are pending against him in other States too. Four witnesses have already been examined. Prayer for bail of co-accused was rejected by coordinate bench of this court on 19.08.2021. We have considered the materials on record. Though petitioner is in custody for protracted period of time, he has criminal antecedents. Other cases are pending against him in different States. Prayer for bail of co-accused was rejected in August, 2021. Since then there is progress in trial. Under such circumstances, we are not inclined to grant bail to the petitioner. However, we request the trial court to conclude the trial as expeditiously as possible at an early date preferably within three

months from the next date fixed for recording evidence without granting unnecessary adjournment.
