Petitioner is aggrieved as the private respondent no.5 is not traceable consequent to which petitioner is suffering, as huge amount of maintenance is pending in connection with M.Ex.118 of 2023 before the learned ACJM, Sealdah. Because of financial stringency, petitioner has approached this Court.

Ordinarily against a statutory order, this Court should not interfere but having regard to the basic social repercussions involved in cases of maintenance, I am inclined to direct that the warrant of arrest which is pending be sent to the Officer-inCharge, Missing Persons Squad, Detective Department, Lalbazar by the court concerned. If within a month from date such order is not received from the learned ACJM, Sealdah, the Officer-in-

Charge, Missing Persons Squad, Detective Department, Lalbazar will make an appropriate application before the learned ACJM, Sealdah. In case the respondent no.5 is traced out, it would be for the Officer-in-Charge, Missing Persons Squad, Detective Department, Lalbazar to produce him before the learned ACJM, Sealdah in connection with M.Ex.118 of 2023.

In case the petitioner prefers an application before the learned ACJM, Sealdah, learned ACJM, Sealdah will prepone the date and re-direct the warrant of arrest to be executed through the Officerin-Charge, Missing Persons Squad, Detective Department, Lalbazar.

With the aforesaid observations, WPA 13623 of 2025 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
