This writ petition has been filed alleging inaction on the part of the Officer-in-Charge, Nandigram Police Station. The contention is that the respondent no.4, who is the son of the petitioner, had been physically torturing the petitioner. Finding no other alternative, the petitioner approached the Officer-in-Charge, Nandigram Police Station for necessary action. The allegation is that no steps were taken by the said authority.

The police authorities have filed a report, from which it appears that the dispute is with regard to property. On enquiry, the police authorities found that the respondent no.4 had demanded some property and money for his business, which the petitioner refused. As a result of which, acrimonious relationship developed between the father and the son. The petitioner also indicated that the petitioner would give all his property to the daughters.

However, the police authorities investigated into the matter and Nandigram Police Station Case No. 418 of 2020 dated December 4, 2020 under Sections 448/323/325/427/506 of the Indian Penal Code was initiated. After completion of the investigation, a charge sheet has been filed vide charge sheet no. 230 of 2020 dated December 23, 2020 under Sections 448/323/325/427/506 of the Indian Penal Code. The matter is pending before the learned A.C.J.M. Haldia. The police authorities have also found that the allegations of life threat were not correct. The police authorities have also submitted that they would render all assistance to the petitioner, if required. Under such circumstances, nothing further remains to be decided in this writ petition. The police authorities shall however keep vigil over the area so that no untoward incident takes place. The report filed by the Officer-in-Charge, Nandigram Police Station is taken on record.

Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
