Bulti Mondal v. The State Of West Bengal And ORS.
D/L 116 04.07.2025 ct. no. 35 Kausik W.P.A. 13474 of 2025 Bulti Mondal
Versus
The State of West Bengal & Ors.
Mr. Pawan Kumar Gupta Ms. Sofia Nesar Mr. Santanu Sett ...for the petitioner.
Mr. Udaynarayan Betal Mr. Bhaskar Hutait Mr. Mriganka Patra ...for the respondent no. 4.
Mr. Joydeep Banerjee Mr. Raja Ram Banerjee ...for the State.
Learned advocate appearing for the petitioner is aggrieved by the fact that in spite of the scheme being allotted to the petitioner at the behest of the private respondents, he is unable to construct his house who is resisting, interfering and obstructing in the implementation of the scheme. Be that as it may, learned advocate for the State has submitted a report. Report reflects that a land dispute has been going on between the respondent no.
and the petitioner for a considerable period of time.
Learned advocate for the respondent no. 4 submits that so far as the right of the respondent no. 4, until and unless, the same is decided, the petitioner cannot construct the house over the land where the scheme has been sanctioned.
Be that as it may, the petitioner has approached this Court, but unfortunately the police authorities have got no role to play in such type of disputes.
Petitioner will approach the appropriate jurisdictional authority or the courts concerned. If the title of the land is decided in favour of the petitioner and thereafter directions are passed upon the police authorities then only police authorities would interfere.
With the aforesaid observations WPA 13474 of 2025 is disposed of.
Report so submitted be kept with the record.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
