Accordingly, he renews his prayer for bail. Learned Advocate for the CBI opposes the prayer for bail and submits petitioner played an active role in the murder. Statement of the injured eyewitness implicates the petitioner. We have considered the materials on record. Statement of the injured eyewitness implicates the petitioner. Bail prayer of another coaccused whose presence at the spot is evident from CCTV footage had been turned down. Petitioner does not stand on the same footing with the other co-accused who have been enlarged on bail. Under such circumstances and in view of gravity of the offence, we are not inclined to grant bail to the petitioner at this stage. The application for bail is thus rejected.
