Banerjee) Mr. Moni Manjusha Nandy ... the petitioner (in-person) This application under Article 227 of the Constitution of India is at the instance of the plaintiff and is directed against an order being no. 63 dated April 2, 2025 passed by the learned Judge, 5th Bench, Small Causes Court at Calcutta in Ejectment Suit No. 219 of 2018. By the order impugned the prayer for adjournment was allowed subject to payment of cost of Rs 10,000/- to be paid by the plaintiff to the DLSA, Kolkata.

The petitioner, appearing in person, submits that the direction upon the petitioner to pay cost, may be deleted.

The petitioner is appearing in person and this court feels that the cost imposed upon the petitioner should be deleted for the ends of justice. Since the cost was directed to be paid to the DLSA, Kolkata, there is no necessity to issue notice upon the opposite party.

In view thereof, the impugned order stands modified only to the extent that the plaintiff/petitioner herein shall not be required to pay the cost of Rs. 10,000/- to the DLSA, Kolkata as directed by the order impugned.

With the above observation, CO 2122 of 2025 stands disposed of.
