Writ petitioners have claimed to have been appointed in the posts of assistant teacher in Titagarh Arya Vidyalaya (for short 'said school'), Distrcit- North 24 Parganas. The common grievance is failure on the part of the concerned respondent authorities to grant approval of appointment of the writ petitioners. During course of submission Mr. Roy, learned advocate has drawn attention of this Court to letter dated 12th July, 2018 issued by the President of the said school addressed to the District Inspector of Schools (S.E.), Baarrackpore seeking approval of appointment. It has been contended on behalf of the petitioners that in spite of making this approach on behalf of the said school authority no steps have been taken by the

concerned respondent authorities for taking decision on such prayer of the school authority. Mr.

Mukheree, learned Additional Government pleader appears on behalf of the State respondents and duly assisted by Ms. Sahili Mukherjee, learned advocate.

It has been submitted on behalf of the State respondents that due to failure on the part of the school authority to follow the procedure regarding appointment of the writ petitioners the issue is pending before the concerned District Inspector of Schools (S.E.), Barrackpore. But it has also been submitted that if necessary direction is given by this Court the issue can be decided by the concerned respondent authorities in accordance with law.

Mr.

Bhattacharyya, leaned advocate appears on behalf of the school authorities being respondent nos.6, 7 & 8 and submits that the issue relating to approval of appointment of the writ petitioners is presently pending before the District Inspector of Schools (S.E.), Barrackpore.

Considering the submissions made on behalf of the parties to this writ petition this Court directs the District Inspector of Schools (S.E.), Barrackpore being respondent no.3 to take decision on the letter of the school authority dated 12th July,

2018, page 70 of the writ petition within a period of twelve weeks from the date of communication of this order after granting opportunity of hearing to one representative of the writ petitioners as well as the school authority and communicate the said decision to the writ petitioners within a period of two weeks thereafter.

With the above direction, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
