1. Learned counsel for the State has filed English translated copy of the statements of the injured persons.

2. The complainant has alleged that the petitioners had assaulted them mercilessly being armed with lathi, iron rod, cycle chain etc.

3. Learned counsel for the petitioners submits that in fact there is an old dispute between the parties and the petitioners have been implicated falsely. Learned counsel also submits that the petitioners have also lodged a case being Itahar Police Station Case No. 390 of 2025 dated 8th June, 2025 against

the de facto complainant and others. Learned counsel further submits that the petitioners are ready to join the investigation.

4. The Court has perused the case diary and the injury reports. All the injured persons have sustained simple injuries. In the injury report there is mention of assault only by wood and there is no mention of assault by iron rod or cycle chain etc.

5. Taking into account, in the event of arrest, the petitioners shall be released on anticipatory bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the condition that the petitioners shall not threaten or intimidate the prosecution witnesses or tamper with the evidence in any manner whatsoever.

The petitioners shall join the investigation as and when directed by the Investigating Officer.

6. Thus, the prayer for anticipatory bail is allowed.

7. CRM (A) 2076 of 2025 is disposed of.

8. Urgent Photostat certified copy of this order be given to the parties upon compliance with all necessary formalities. ( Dinesh Kumar Sharma, J. )
