The State of West Bengal Mr. Angshuman Chakraborty Mr. Shashanka Sekhar Saha ...for the petitioners Mr.Tanmoy Kumar Ghosh Ms. Puspita Saha ..for the State The petitioner has approached this Court for expeditious disposal of a case under Section 21(C)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereafter described as the said Act) which was registered as N.125/2021 arising out of Baduria Police Station Case No.583 of 2021 dated 27th September, 2021 On perusal of the averment made in the instant revision this Court is of the view that this revision can be disposed of here and now with the assistance of learned P.P.-in-charge. Mr. Tanmoy Kumar Ghosh and Ms. Puspita Saha, learned advocates on behalf of the State are requested to assist this Court. Their
appointment be regularized by the learned Legal Remembrancer, Government of West Bengal.
Learned advocate for the petitioner is directed to serve a copy of the application to the learned advocates for the State.
It is alleged by the petitioner that he was arrested in respect of the above mentioned case on 27th September, 2021. Charge sheet was submitted on 18th November, 2021 showing seven witnesses. On 2nd February, 2022 subsequently the charge sheet was submitted. The trial Court framed charge against the accused on 10th March, 2022. Subsequently, on 10th June, 2022 date was fixed for examination of witnesses. But no witness turned up. Next date for recording of evidence is fixed on 14th September, 2022. On perusal of the charge sheet I find that except C.S.W.No.7 all witnesses are police personnel. Therefore, the Investigating Officer ought not to have any difficulty to produce the witnesses.
Therefore, instant revision is disposed of directing the trial Court to examine at least two witnesses on `14th September, 2022. Thereafter the learned trial Court shall fix a schedule for examination of witnesses and conclude the trial of the case expeditiously.
With the above order the instant revision is disposed of.
