Heard Learned Counsel for the parties.

The petitioner, who is the elder son of the informant, a lady aged about 84 years old is alleged to have assaulted her for the sake of property though the informant is stated to have equally divided the property amongst her sons. The injury sustained by the victim mother is, however, simple and whatever be the sentiment of a mother, she never curses a son. She always wants well being of her sons. 3.

In view of such fact and substantial progress in the investigation, it is directed that the petitioner shall be released on bail in the event of his arrest by the Arresting Officer in the aforesaid P.S. case on such

terms and conditions as deemed just and proper in the facts and circumstances of the case including the condition that he shall appear before the I.O. once in a week on the day and time fixed by the I.O. till submission of F.F. The petitioner shall not come to the area where his mother is living.

Within 21 days from the date of receipt of server copy/certified copy of this order the petitioner is directed to appear before the I.O. along with a copy of such order.

Accordingly, the prayer for anticipatory bail is allowed.

The application being CRM (A) 2311 of 2023 is disposed of.
