The present writ application has been preferred praying for direction upon the Certificate Officer to execute the Certificate dated 17th December, 2021 in totality.
It is submitted that the certificate in respect of compound interest to which the petitioner is entitled has not been executed and as such the petitioner has not received the same.
It is further submitted that the last orders passed by the Certificate Officer in the proceedings was on 21.8.2023 and
19.9.2023. Since then there has been no steps taken by the Certificate Officer in respect of the said dues of the petitioner.
On hearing the parties and considering the materials on record, the writ application is disposed of with the direction that the Certificate Officer being the respondent no.
4 shall conclude the proceeding in the certificate proceeding which is to be concluded by virtue of such notices dated 21.8.2023 and 19.9.2023 and dispose of the proceeding in totality in respect of the dues to which the petitioner is entitled within 30 days from the date of communication of this order.
Let a copy of this order be sent to the District Magistrate, Howrah for supervision and to ensure that the Certificate Officer complies the direction of this Court diligently.
Urgent Photostat certified copy of this order, if applied for, be given to the learned counsel for the parties on usual undertakings.
