Kausik (Allowed) CRM (NDPS) 1380 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 1956/2025 dated 25.11.2025 under Sections 21(C)/29/27A of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits petitioner is in custody for 96 days. Charge sheet has been submitted and the subject matter of the case relate to alleged recovery of 4 Kgs. 727 Gms. of Brown Sugar from the possession of another accused, namely Samsul Zoha Sekh. Petitioner is similarly placed as the other accused person namely, Md. Nasim Sk.

Learned advocate for the State opposes the prayer for bail but is unable to refute the locus of the present petitioner being similar to that of Md. Nasim Sk.

Having considered that the other accused Md. Nasim Sk. has been granted bail, I direct that the petitioner also may

be released on bail on the same terms and conditions as was imposed upon Md. Nasim Sk. in CRM (NDPS) 1214 of 2026. As such, prayer for bail of the petitioner in CRM (NDPS) 1380 of 2026 is allowed.

Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
