Versus

The writ petitioner had the post graduate degree with BA with Honours and was issued appointment letter to the post of Assistant Teacher for Class 9 & 10 on the basis of the recommendation of the West Bengal Central School Service Commission.

Originally the petitioner was appointed on 24th August, 2018, to Sarbamangala High School. No vacancy was available in the post of Life Science teacher in the said school. The petitioner was later on issued letter of appointment on 21.01.2019, to join the Kashinathpur J. K. High School as an Assistant Teacher on the subject of Life Science for Class 9 &

10. The petitioner has produced documents to indicate that he was teaching higher secondary students also in the said Kashinathpur J. K. High School.

The petitioner seeks a direction upon the respondents to convert his appointment from that of graduate teacher to a post graduate teacher in the higher secondary section.

The petitioner shall make a fresh representation within a period of two months from date to the respondent no. 4, enclosing therewith all credentials for the purpose of aforesaid conversion. Upon receipt of the said representation, the respondent no. 4 shall, if necessary, call for records of the petitioner's functioning in the Kashinathpur J. K. High School, Daspur-2, Paschim Medinipur, and pass a reasoned order within seven days thereof.

Let a copy of this order along with the writ petition be served on the respondent no. 4.

The writ petition is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
