The petitioner has filed an application under Order IX Rule 9 of the Code of Civil Procedure being Misc. Case No.08 of 2022 for restoration of the suit filed by her before the 2nd Court of the learned Civil Judge (Senior Division), at Barasat, District- 24Parganas (North) being Title Suit No.25 of 2018,. The petitioner, for expeditious disposal of the said misc. case, had prayed for preponement of the date fixed for hearing of it.

The 2nd Court of the learned Civil Judge (Senior Division), at Barasat, District- 24-Parganas (North) by the order dated May 06, 2024 has refused the said prayer of the petitioner on the ground that the diary of the Court is overburdened. The hearing of the said Misc. Case is fixed on June 15, 2024.

In view of nature of the said Misc. Case, the learned Trial Judge is requested to expedite the disposal of it. C.O. 1915 of 2024 is disposed of without any order as to costs.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
