The petitioner is aggrieved by a bamboo fence erected by the private respondents on his land. Counsel for the State submits that a portion of the fence is on the PWD land. State has further taken out proceedings under Section 107 of the Cr. P. C. against the private respondents.

This Court is of the view that the dispute as regards the title of the land has to be decided before a civil or statutory forum. The Writ Court cannot enter into such dispute.

The I. C., Dholahat Police Station shall ensure that there is breach of peace in the area.

The writ petition is disposed of.

Instructions of the I. C., Dholahat Police Station is taken on record.
