The writ petitioner complains that the private respondents are encroaching upon his land. The petitioner obtained a decree against the private respondents in T. S. No. 168 of 2003 from the court of the learned Civil Judge, Baruipur, South 24 Parganas. Proceedings under Section 144 of the Cr. P. C. have been taken out.

This Court is of the view that the remedy of the petitioner is to seek enforcement and/or execution of the decree in the court below.

The O. C., Jibantala Police Station shall ensure that there is no breach of peace in the area. In view of the above, the instant writ petition is disposed of.

There will be no order as to costs.
