Heard the learned Counsel for both the parties. 2.

Though the case is admittedly based on circumstantial evidence, taking into consideration the circumstances involved and especially the fact that the number of cases for different offences are there against the petitioner, though the petitioner is stated to be on bail in those cases, we are not inclined to exercise our discretion in favour of the petitioner under Section 439 Cr.P.C at this stage.

Accordingly, the prayer for bail of the petitioner is rejected. 4.

CRM (DB) 2286 of 2023 is dismissed.

The petitioner shall be at liberty to renew his prayer for bail if trial is not commenced within six months from today. (Chitta Ranjan Dash, J.) (Partha Sarathi Sen, J.)
