Learned advocate appearing for the petitioner submits that the petitioner was falsely implicated in the instant case. Petitioner is neither the beneficiary of the stolen amount nor did he steal the amount.

Learned advocate appearing for the State draws attention of the Court to the materials in the Case Diary and the statement recorded under Section 161 of the Code of Criminal Procedure.

Considering the facts and circumstances of the case and the materials available in the Case Diary and the complicity of the petitioner as appearing therefrom, prima facie, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM 5994 of 2021 is dismissed.
