The petitioner was a Group-D Staff of Petbindhi D.K.M. High School (H.S.), District : Paschim Medinipur. The grievance of the petitioner is that he is receiving pension but without the benefit of ROPA 2019 though he is entitled to the said benefit.

Mr.

Prasad, learned Advocate for the State respondents submits that as prayed for the petitioner has been given the benefit of the ROPA 2019. He files photocopy of the revised Pension Payment Order of the petitioner, let it be kept with the record.

Mr. Mitra, learned Advocate for the petitioner does not dispute such development.

In view of the aforesaid, no further order need be passed in the writ petition.

WPA 13604 of 2023 is disposed of without any order as to costs.

This order, however, will not prevent the petitioner to apply for interest on the arrear amount of gratuity and pension to be calculated on the basis of the said revised Pension Payment Order.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
