Learned counsel for the petitioners alleges that a fire broke out in the premises where the petitioners run their business. Subsequently, an insurance claim was made. The respondent no. 4 is a corporate broker. But, neither the Insurance Corporation nor the corporate broker took steps for assessing the damages and the claim of the petitioners.
Learned counsel for the Insurance Company takes a fair stand that since a claim has been raised by the petitioners, the same is
required to be decided either way by the Insurance Company.
Accordingly, WPA No. 13609 of 2023 is disposed of by directing the respondent nos. 2 and 3, that is, the Oriental Insurance Company Limited and its Manager, to ensure that the claim of the petitioners for the amount of insurance be processed at the earliest and a decision be taken thereon in accordance with law, preferably within four weeks from date.
Immediately thereafter, the respondent nos. 2 and 3 shall communicate such decision to the petitioners.
In the event it is assessed that a particular amount of insurance claim is payable to the petitioners, the respondent nos. 2 and 3 shall take appropriate steps to disburse the amount to the petitioners expeditiously.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
