Learned Advocate appearing for the petitioner submits that the petitioner is in custody for 90 days. The police submitted charge-sheet and, therefore, further detention of the petitioner is not required. He submits that the petitioner was named by the co-accused.
Learned Advocate appearing for the State draws the attention of the Court to the case diary and particularly to the statement recorded under Section 161 and 164 of the Code of Criminal Procedure of the victim girl. He submits that there are materials available to the police to substantiate that the petitioner is involved in the crime.
Considering the facts and circumstances of the case and considering the materials in the case diary, we are unable to grant bail to the petitioner. C.R.M. 5956 of 2021 is dismissed.
