Mr. Arunava Ganguly ...for the petitioner Since this is the second round of revisional application with the prayer for expeditious disposal of title suit no. 21 of 2014, no previous service is required to be effected on the opposite parties.

The petitioner will be obliged to forward a copy of the order to the opposite party without delay. The petitioner contended that opposite party filed title suit no. 21 of 2014 which was renumbered as title suit no. 95 of 2015 pending before the court of learned Civil Judge (Senior Division), Arambag, Hooghly and the suit relates to partition of the suit property. On earlier occasion, this court, while disposing of C.O. 3072 of 2017, was pleased to direct the trial court to dispose of as expeditiously as business hours of that court would permit without granting any adjournment to the parties. Five years have already been passed since passing of that order but the petitioner is still not taking any effective steps for disposal of the aforesaid suit and the suit is still pending for disposal.

In such circumstances, the petitioner has prayed for further direction upon the court below for expeditious disposal of the suit.

Having considered and facts and circumstances of the case and that the prayer made by the petitioner is innocuous and that a direction in this regard has already been passed by this court, the learned trial court is directed to make every endeavour to expeditious disposal of the suit and to conclude the entire proceeding of the suit preferably within a period of one year from the communication of the order.

Accordingly, the application being C.O. 1616 of 2021 is disposed of.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
