Mr. Samim Ahammed Mr. Gulsanwara Pervin ...for the petitioner Mr. Ashis Kumar Paul Mr. Alok Benerjee ...for the State The grievance of the petitioner is directed against the non-consideration of a representation dated 24th April, 2024 complaining of alleged illegal and unauthorised construction by the private respondent.

The State is represented and files a Report of the concerned Police Station suggesting that there has been a civil dispute pending between the parties and a Civil Suit being Title Suit No. 462 of 2024 has been filed before the learned Civil Judge (Senior Division), 10th Court at Alipore, South 24 Parganas. In view of the above, the State submits that there is no question of passing any order in favour of the petitioner.

In view of the fact that the petitioner had filed the representation as far back as in April, 2024, WPA 14763 of 2024 stands disposed of by directing the concerned Pradhan, being the respondent Nos. 5 to consider and dispose of the representation dated 24th April, 2024 within a period of six weeks from the date

of communication of this order to the said respondent after giving a right of hearing to all the affected parties, in accordance with law and without being influenced by any observation made in this order.

It is made clear that there has been no adjudication on the merits of the case and all questions are left open to be decided by the respondent Nos. 5 in accordance with law.

There shall be no order as to costs.

Since affidavits have not been invited, the allegations made in the writ petition are deemed not to have been admitted.
