This is blocking the ingress and egress to the petitioner's property. Accordingly, the petitioner made a representation on 01.05.2024 before the concerned authorities including the Sub-Divisional Officer, Kharagpur Sub-Division, but the same has not been responded as yet.

Learned counsel for the private respondent denies the allegations and submits that the property is a joint one and the private respondent is a co-sharer in the same. The allegations are absolutely misconceived. No one represents the State.

It appears that a representation of the petitioner dated 01.05.2024 is pending consideration before the concerned authorities.

In view of the above, let the SDO, Kharagpur SubDivision consider the petitioner's representation dated 01.05.2024 in accordance with law and upon hearing all the interested parties as expeditiously as possible, preferably within eight weeks from the date of communication of this order.

It is made clear that the merits of the case have not been gone into.

With these observations, the writ petition is disposed of.

As affidavits were not called for, the allegations made are deemed not to have been admitted.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance of all requisite formalities.
