The petitioner is an Assistant Professor of the subject Political Science at Manbhum Mahavidalaya, a State-aided college under Sidho Kanho Birsha University (SKBU).

The petitioner is claiming to have 40% disability by way of visual impairment and on the said ground, has applied for transfer to a college nearer to her residence. The petitioner is praying disposal of the said application.

The West Bengal Colleges (Transfer of Employees) Rules, 2017 ( 'the Rules of 2017' in short,) is the relevant rules under which the petitioner is to apply for transfer, Rule 5 thereof prescribes that the application for transfer must be made in FormI appended to the Schedule of the said Rules of 2017. The application of the petitioner is not in the said form, besides there are other requirements under the said Rules of 2017 to apply for such transfer, which are lacking in the said application; therefore the pending representation of the petitioner cannot be directed to be considered, instead, leave is granted to the petitioner to apply for transfer afresh in terms of the said Rules of 2017. In the event such an application is made, the Director of Public Instruction, Education Directorate, the respondent no. 2 herein shall dispose of the said application expeditiously in accordance with law.

WPA 13702 of 2025 is thus disposed of without any order as to costs.
