1. Writ petitioner and the alleged contemnors are represented through their respective learned advocates.

2. Mr. Ghosh, learned advocate appearing on behalf of the writ petitioner draws attention of this court to the internal page No.20 of the judgment dated 25th March, 2025, as passed in WPA 12430 of 2013. Drawing attention to page No.43 to 46 and also to the subsequent pages of the instant contempt application it is further submitted by Mr. Ghosh that the copy of the aforementioned judgment has already been served upon the alleged contemnors by Speed Post under the cover of a letter dated 1st April, 2025, which has been received by the alleged

contemnor soon thereafter, that is, on 2nd April, 2025.

3. Learned advocate appearing on behalf of the alleged contemnors upon instruction submits before this court that challenging the said judgment an intra-court appeal being MAT 1146 of 2025 has been filed. However, no stay order has been passed by the Hon'ble Division Bench which is seisin over the matter.

4. It is further submitted on behalf of the alleged contemnors that in course of the day he will supply a copy of the Memo of Appeal along with interlocutory application, if there be any to the learned advocate for the writ petitioner.

5. It is further submitted on behalf of the alleged contemnor that the learned advocate-on-record may be directed to serve the instant contempt application along with all annexures to him.

6. Prayer for adjournment is vehemently opposed by Mr. Ghosh.

7. After careful perusal of entire materials placed before me, this court requests the learned advocate for the alleged contemnor to cause service of a copy of the Memo of Appeal along with copy of the interlocutory application, if there be any, as pending before the Hon'ble

Division Bench, positively within three working days from today.

8. Learned advocate-on-record for the writ petitioner is also requested to supply a copy of the instant contempt application to the learned advocate for the alleged contemnor along with all annexures also within three working days from today.

9. Prayer for accommodation is considered and allowed as a last chance.

10. Let this matter be listed for further consideration in the week commencing from 11th May, 2026, under the same heading.

11. It is made clear that in the event the present alleged contemnors fail to bring any stay order from the Appellate Court, this court shall have no other alternative but to proceed with the instant contempt application and this court may issue rule of contempt against the alleged contemnors.
