This application under Article 227 of the Constitution of India is at the instance of the defendants praying for a direction upon the learned Additional District Judge, 8th Court at Barasat, North 24-Parganas to dispose of the Misc. Appeal No.162 of 2024 expeditiously.

Mr. Mondal, learned advocate appearing for the petitioner submits that the Miscellaneous Appeal is pending from the year 2024. He further submits that the opposite party herein obtained an ad interim order of injunction and the petitioner is suffering such order of injunction from the year 2024.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of notice upon the opposite party. However, the learned advocate on record for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned advocates representing them before the learned Trial Judge.

Upon the order-sheets appended to the revisional application, this Court finds that 08th July, 2025 has been fixed

for filing show cause by the respondents/opposite parties herein as to why the appeal should not be heard ex parte. In the light of the submission made by the learned advocate for the petitioners CO 2140 of 2025 is disposed of by requesting the learned Additional District Judge, 8th Court at Barasat, 24-Parganas, North to make an endeavour to see that the Misc. Appeal No.162 of 2024 is disposed of as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
