This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, 3rd Court at Barrackpore to dispose of Matrimonial Suit No.1012 of 2017 expeditiously.

Mr. Das, learned advocate appearing for the petitioner submits that the wife of the opposite party herein is delaying the hearing of the matrimonial suit, which is pending from the year 2017. He further submits that the petitioner is paying alimony in terms of the order passed by the learned Trial Judge.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of notice upon the opposite party. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned advocates representing the opposite parties before the learned Trial Judge.

From the order-sheets appended to the revisional application, it finds that 26th June, 2025 has been fixed for cross examination of PW-1.

In the light of the submission made by the learned advocate for the petitioner CO 2141 of 2025 is disposed of by requesting the learned Additional District Judge, 3rd Court at Barrackpore to make an endeavour to see that the Matrimonial Suit No.1012 of 2017 is disposed of as expeditiously as possible without granting any unnecessary adjournments to either of the parties provided the husband/petitioner herein is not in default in payment of alimony.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
