From the order-sheets appended to this application, this Court finds that the summons of the suit is yet to be served upon the added defendant. Faced with such situation, learned advocate appearing for the petitioner prays that the Misc. Case No. 22 of 2024 filed by the petitioner herein alleging violation of an order of injunction be disposed of expeditiously.

However, after going through the order-sheets of Misc. Case No. 22 of 2024, this Court finds that February 23, 2026 was fixed for hearing of the Misc. case.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any

notice upon the opposite party. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite party or upon the learned advocate representing the opposite party before the learned trial judge forthwith.

In the light of the submission made by the learned advocate appearing for the petitioner, CO 1989 of 2026 stands disposed of by requesting the Learned Civil Judge (Jr. Division), 1st Court at Diamond Harbour to make an endeavour to take up the hearing of Misc. Case No. 22 of 2024, if the same is otherwise ready for hearing and to make an endeavour to dispose of the as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
