The petitioner claims to be running a stall as a sub licensee nominated by Banglar Dairy Limited formerly Mother Dairy. The petitioner, through his legal representative, filed a representation before the Senior Divisional Commercial Manager objecting to the hike in the license fee and seeking renewal of the agreement for running the subject stall. The same is pending consideration.

Without entering into the merit of the claim and counter claim of the parties, the instant writ petition is disposed of by directing the respondent no. 5, Senior Divisional Commercial Manager, Kharagpur Division, South Eastern Railway to consider and dispose of the legal representation filed on behalf of the petitioner strictly in accordance with law, after giving reasonable opportunity of hearing to all the necessary parties including Banglar Dairy Limited by passing a reasoned order at the earliest, but positively within a period of four weeks from the date of communication of this order. 4.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
