Case No. 217 of 2025 arising out of Khatra Police Station Case No. 22 of 2025 dated 18.04.2025 under Sections 126(2)/117(2)/118(2)/109(1)/351(2)/3(5) of the Bharatiya Nyay Sanhita 2023.

Mr. Prasun Kumar Dutta, Ld. APP Ms. Baishakhi Chatterjee ... for the State Learned counsel for the petitioners submits that petitioners have been falsely implicated by engineering a false and cocktail story under the political pressure.

Learned counsel submits that co-accused has been admitted bail.

It has further been submitted that as per instruction the injured discharged on the same date. Learned counsel for the State has opposed the bail application stating that the injured suffered head injury.

Learned counsel further submits that investigation is still continuing. Injury report in the Case Diary indicates that the injured was assaulted with lathi and there was a cut injury. It has also

been brought on record that the same date of occurrence prior to this incident the accused person allegedly assaulted another person for which Khatra P.S. 23 of 2025 dated 18th April, 2025 under Section 126(2)/115/35 BNS has been registered.

Learned counsel for the petitioner submits that in fact this First Information Report has also arisen out of the same incident.

Be that as it may be, the point is that there are two cases against the petitioners involving serious offence, weapon of offence is yet to be recovered. The injury was on the vital part of the body.

Taken into the facts and circumstances of this case the petitioners are not entitled bail.
