Petitioner is aggrieved by the fact that the private 04.08.2025 Court No. 35 M/L. No.642 Rakib respondents had been extorting money from him. To that effect he informed the local police station but the local police station being influenced by the private respondents did not take any steps.

State has submitted a report. Report reflects that the petitioner subsequently communicated with the Superior Officer of Police as there was a settlement between the parties.

As the learned advocate appearing for the petitioner opposes such contention, I am of the view that if the petitioner has sufficient materials in his custody, he would advance a prayer under Section 175(3) of the BNSS before the jurisdictional Magistrate. Learned jurisdictional Magistrate will assess and ascertain the truth of the accusations and thereafter pass necessary directions upon the police authorities.

With the aforesaid observations WPA 14924 of 2024 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
