Roy Mr. Joydip Roy ...for the State The writ petition is taken up for consideration pursuant to the order dated 18th August, 2023 when no one appears for the petitioner and no accommodation is prayed for. However, State-respondents as well as respondent no. 2 are represented by learned advocates. By order dated 18th August, 2023 this Court directed the learned Registrar General, High Court, Calcutta to submit a report whether the writ petitioner deposited sum of Rs. 20 lakhs with the office of the Registrar General or not in terms of the order dated 29th July, 2016. Pursuant to such direction as contained in the order dated 18th August, 2023 Assistant RegistrarVIII has furnished a report dated 4th September, 2023 whereby it has been disclosed that as per reports submitted by Accounts Department (Ledger Branch) as well as Cashier, Appellate Side it has been found that the aforesaid amount has not been deposited yet with the registry.

Since the said sum was not deposited by the writ petitioner within the time stipulated in the order dated 29th July, 2016 passed by the coordinate Bench the interim order of stay of operation of the impugned order stood vacated after a period of two weeks from the date of passing order on 29th July, 2016.

It also appears that petitioner has lost interest in the fate of this writ petition since it has been found on repeated occasion petitioner is not represented. Accordingly, the writ petition stands dismissed. There shall be no order as to costs.
