Ratul Biswas, learned counsel appearing for the Board has clarified that the cut off marks for the candidates in the recruitment process for the particular district and category in which the petitioner participated was 15.965% marks. The petitioner was admittedly an untrained candidate since he possessed B. Ed. qualification. Admittedly, B. Ed.

qualification was treated as a training qualification by a special notification issued in special circumstances by the NCTE sometime in the year 2018.

For the aforesaid reasons the writ petitioner was not empanelled in the list of successful candidates in the year 2016.

For the reasons stated above, no relief can be granted to the petitioner.

W.P.A. 13677 of 2023 fails and is hereby dismissed.

However, based on the marks applied before this Court in its report by the CBI, the petitioner may be issued a TET certificate. The CBI shall furnish subject wise break up of the marks obtained by the petitioner in the TET examination of for the aforesaid purpose, if available with them.

The petitioner is admittedly a TET qualified candidate even as per the Board.

There shall be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
